Who Is Eligible?
U.S. Citizenship and Immigration Services (USCIS) may grant DACA to an applicant who:
- Was under the age of 31 as of June 1, 2012;
- Came to the US before the age of 16;
- Has continuously resided in the US since June 15, 2007;
- Was physically present in the US on June 15, 2012, and at the time of filing;
- Had no lawful immigration status on June 15, 2012, and at the time of filing;
- Are enrolled in school, have graduated or obtained a certificate of completion or GED, or are an honorably discharged veteran of the US Armed Forces or Coast Guard; and
- Have not been convicted of certain crimes.
Due to ongoing litigation, USCIS currently is not making a final decision on, initial applications for individuals who may meet the requirements for DACA. USCIS will make a final decision on an application to renew DACA that is timely filed or filed within one year of expiration. If you previously held DACA but failed to renew within one year of its expiration, you should consult with an immigration attorney.
