Employment-Based Labor Certifications in Dallas
Put Years of Experience in Your Corner
A PERM labor certification is required by all employers who are seeking to bring foreign nationals into the U.S. for the purpose of employment. This is the first step in the employment-based visa process. The employer must submit an application to the Department of Labor demonstrating the need for the foreign worker's skill and how that skill cannot be replicated by a U.S. worker. The purpose of this process is to protect U.S. workers from being adversely affected by the introduction of foreign labor.
When an employer wants to sponsor a foreign worker for a green card, the employer must undergo a three-step process:
- Obtain Alien Labor Certification through the PERM process
- I-140 Immigration Petition for Alien Worker
- I-485 Application for Adjustment of Status (Green Card)
PERM Labor Certification Requirements-
The PERM Labor Certification process can begin when all requirements are fulfilled. Both the employer and prospective employee have certain obligations that must be fulfilled.
Requirements for PERM labor certification:
- The employee must be hired full-time by the U.S. employer
- The position must be a bona fide job offer that is also available to U.S. workers
- The job qualifications must be standard and not tailored specifically for the foreign worker.
- The wage for the position must meet prevailing wage requirements (equal or greater than the average wage for those similarly employed)
- The employer must show that there are no qualified U.S. workers available for the job and that hiring the foreign worker will not negatively impact U.S. workers

My journey started with Akula & Associates exactly 10 months ago. Came to know about them through a friend, casually called, impressed with their profile and signed up contract for services. Last 10 months we filed several cases and each case they treat like a completely new customer and examine each document thoroughly, advise and make us on top of the things. I truly say sincere THANKS for their great service. I truly love their staff. My paralegal Yezenia is awesome, attorney Toki is wonderful. Yet to work more with GC team, Shirin and Christie, great work experience so far. Last but not least Attorney Kavitha is Great!!! The attorneys and paralegals and their assistants at Akula Law in Dallas handled my immigration case for the US efficiently, with care and with attentive responses to questions. Katrina was our lawyer for the remaining few months of our case, originally started by Daniele. Also with Erika and Christie helping us, and despite COVID-19 I finally arrived in the US in June and we couldn’t be happier. Thank you all!

I just want to take a moment and personally thanks Kavitha & Akula Law Firm for helping me out and getting through my complicated I140 case. It was a impossible case which Kavitha made it possible. As usual Kavitha's expertise has been phenomenal. I am very grateful to her. Because of her experience and professionalism in filing the I-485 it didn't even trigger an RFE or an interview request, it was a direct approval. And having Ambreen and other expert counsel members are really great to work with. They are prompt and very helpful. Ambreen, is so wonderful and have dealt so patiently and promptly with me during my I485 and the efforts she have put towards my application was at par. I was fortunate to work with Ambreen during this filing period. Highly recommended and great law firm.- Mohmmed K.
