On June 18, 2024, through executive actions, the Biden administration announced a new policy that will support family unity by permitting undocumented spouses of U.S. citizens to ultimately obtain green cards. In summary, undocumented spouses of U.S. citizens who have been in the U.S. for a decade or longer will have a legal avenue to eventually adjust their immigration status.
To be eligible the undocumented spouse must:
• Be present in the U.S. without being admitted or paroled (EWI);
• Have been continuously present in the U.S. for at least 10 years as of June 17, 2024;
• Have a legally valid marriage to a U.S. citizen as of June 17, 2024; and
• Have no disqualifying criminal history and to not pose a threat to national security or public safety.
In addition, the Administration is taking action to facilitate the employment visa process for those who have graduated from college and have a high-skilled job offer, including DACA recipients and other Dreamers. To learn more, go to The White House Fact Sheet.
