Requirements for U Status or a U Visa
If you are a victim of a qualifying crime, report it to the police, and you must be willing to help law enforcement authorities in the investigation or prosecution of the criminal activity, you may be eligible to apply for U status or a U visa. Examples of qualifying crimes include, but are not limited to, domestic violence, felonious assault, aggravated robbery, aggravated assault, kidnapping, sexual assault, stalking, and other crimes. An applicant must demonstrate that he or she has suffered substantial physical or mental abuse as a result of having been a crime victim. The applicant must also demonstrate that he or she has information about the crime and has been helpful (or is likely to be helpful) to law enforcement’s investigation or prosecution of the criminal in court. The qualifying crime must have occurred in the United States or have violated United States law.
U status and U visa applicants must demonstrate that he or she is admissible to the United States. If a U status or U visa applicant is inadmissible due to a prior immigration offense such as entering the United States without permission or receiving a removal order from an immigration judge, he or she may be eligible to apply for a waiver that will allow the applicant to receive the requested immigration benefits.
Family Members of Victims of Qualifying Crimes
Applicants may be eligible to sponsor children or spouses through this program. Applicants who are under 21 years of age may be eligible to sponsor spouses, children, parents, and unmarried siblings in some cases. If your relative resides outside of the United States, it may be possible for them to obtain a U visa from a U.S. consulate abroad that will allow them to join you in the United States.
